These terms cover your use of the mTally app and this website. Using mTally means you accept them.
License
mTally is licensed, not sold. Your use of the app is also governed by Apple's Licensed Application End User License Agreement, which applies in addition to these terms. Where the two conflict on a point Apple's agreement covers, Apple's agreement controls.
Subscriptions
- mTally is offered as an auto-renewing subscription: $9.99 per month or $99.99 per year.
- New subscribers get a 14-day free trial. Trial eligibility is determined by Apple based on your Apple Account.
- Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial if you do not cancel first.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple Account settings. Cancelling stops future renewals; it does not retroactively refund the current period.
- If you cancel during the free trial, you are not charged.
Refunds
All purchases are handled by Apple, so all refunds are handled by Apple. We cannot issue refunds directly. Request one at reportaproblem.apple.com.
Your content
Your drawings, projects, takeoffs, and exports are yours. We claim no rights over them and, as described in our Privacy Policy, we have no access to them. You are responsible for having the right to use any drawings you open in mTally.
Backups
You are responsible for maintaining backups of your work. Keep source drawings and exported takeoffs somewhere durable.
Accuracy and professional judgment
mTally is a measurement and counting tool. Results depend on the accuracy of the drawings you supply and the scale you set. Always verify quantities before relying on them for a bid, a purchase, or construction. mTally is not a substitute for professional judgment and does not guarantee the accuracy or completeness of any takeoff.
Disclaimer of warranties
mTally is provided "as is," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost bids, cost overruns, or lost data arising from your use of mTally. Our total liability is limited to the amount you paid for the app in the twelve months preceding the claim.
Acceptable use
Do not reverse-engineer, decompile, or redistribute the app, and do not use it to violate the law or anyone's intellectual property rights.
Changes
We may update these terms. The current version is always posted here with its effective date. Continuing to use mTally after a change means you accept the updated terms.
